Equipment Hire Agreement

Version 3.0, July 2026. This is the contract behind every hire booking, word for word. It applies together with your booking and the Creative Kicks Master Terms 2026.

Key hire terms

Hire fees must be paid before collection or dispatch. A security deposit or card authorisation applies, starting at $200 and increasing with the booking value and risk.

Change of mind cancellation: 48 hours or less, no refund. More than 48 hours but less than 15 days before the Hire Period begins, 50% refund. 15 days or more, full refund. Approved non recoverable third party costs remain payable.

These cancellation terms do not limit any rights or remedies that cannot lawfully be excluded.

The optional Damage Waiver costs 10% of the equipment hire subtotal, minimum $25 plus GST. It caps covered accidental damage at $1,000 per separate incident but does not cover loss, theft, misuse or excluded high risk damage.

The full Creative Kicks Master Terms 2026 also apply. This Agreement applies together with the accepted Quote and the Master Terms. Capitalised terms not defined here have the meaning given in the Master Terms.

1. Booking, payment and security

1.1 The Hire Fee must be paid before collection or dispatch unless Creative Kicks approves account terms in writing.

1.2 The Client must provide the security deposit or card authorisation stated in the booking. The amount starts at $200 and may increase according to the equipment value, hire duration, transport, location and assessed risk.

1.3 A card authorisation is not payment. Creative Kicks may capture some or all of it where an amount becomes properly due under this Schedule.

1.4 If loss, damage, late return, cleaning, missing items or another charge is identified, Creative Kicks will provide the Client with a reasonable written explanation and available supporting material. Creative Kicks may capture the security deposit or card authorisation to preserve the security while the amount is assessed and will promptly refund any balance not properly payable.

1.5 If the amount properly due exceeds the security, the Client authorises Creative Kicks to charge the payment method supplied where the payment provider permits it, after written notice and an itemised basis. Otherwise, Creative Kicks may issue an invoice.

2. Hire period and responsibility

2.1 The Hire Period begins when the Equipment is handed to the Client, its representative or its nominated carrier, and ends when Creative Kicks receives and checks the Equipment back in.

2.2 The Client is responsible for the Equipment during the Hire Period, except for fair wear and tear or loss or damage caused by Creative Kicks or a carrier for which Creative Kicks is responsible under clause 11.

2.3 Responsibility includes safe custody, authorised operation, secure transport and storage and protecting the Equipment from theft, weather, liquids, dust, sand, salt, heat, impact and unauthorised access.

3. Condition and faults

3.1 Creative Kicks will provide the Equipment in serviceable condition, subject to any condition report or disclosed marks.

3.2 The Client must inspect the Equipment on collection or delivery and notify Creative Kicks of any visible issue as soon as reasonably possible and before use where practicable.

3.3 The Client must stop using Equipment that appears unsafe or defective and contact Creative Kicks. The Client must not attempt a repair, open a sealed device, alter firmware, modify cabling or substitute parts without written approval.

3.4 Where a genuine fault is not caused by the Client, Creative Kicks will use reasonable efforts to provide a replacement, repair, credit or refund for the affected item, subject to availability and the Australian Consumer Law.

4. Permitted use

4.1 Only competent and authorised people may use the Equipment. The Client must follow instructions, manuals, safety warnings and applicable laws.

4.2 The Equipment must not be sub hired, sold, pledged, altered, removed from the approved location or used for an unlawful, unsafe or unintended purpose without written approval.

4.3 The Client must not leave the Equipment unattended in an unsecured place, visible in an unattended vehicle, or otherwise stored contrary to reasonable security requirements supplied by Creative Kicks or its insurer.

5. Return, extensions and late return

5.1 The Client must return all Equipment, cases, accessories, batteries, cables and components by the agreed time and in the same condition, allowing for fair wear and tear.

5.2 An extension is only valid when Creative Kicks confirms it in writing. Additional Hire Fees apply.

5.3 If the Equipment is not returned by the agreed time and Creative Kicks has not approved an extension in writing, Creative Kicks may charge one additional daily hire rate. A further daily hire rate may apply for each additional 24 hour period or part of a period that the Equipment remains overdue. Creative Kicks may also recover reasonable documented costs directly caused by the delay, including replacement equipment required for another confirmed booking.

5.4 If the Client cannot return the Equipment on time, it must contact Creative Kicks immediately. Silence does not create an extension.

6. Cleaning, packing and consumables

6.1 The Client must return the Equipment clean, dry, correctly packed and with cables properly coiled and secured.

6.2 Creative Kicks may charge reasonable cleaning, decontamination, repacking and bench labour at the rate of $75 per hour ex GST.

6.3 The Client must pay for missing or consumed items that were not included as consumables in the Hire Fee.

7. Loss, theft and damage

7.1 The Client must notify Creative Kicks immediately of loss, theft, damage, seizure, accident or suspected unauthorised access.

7.2 For theft or suspected criminal activity, the Client must promptly report the matter to police, obtain an event number or report, and reasonably assist Creative Kicks and its insurer.

7.3 Where the Client is responsible, it must pay the reasonable cost of assessment and repair. If repair is not reasonably economical or the item is lost, the Client must pay the reasonable cost of replacing it with the same item or a reasonably equivalent item, taking account of age, condition, availability, fair market value and any salvage value where appropriate.

7.4 Creative Kicks will not recover more than its actual reasonable loss and will credit any insurance recovery or salvage amount received for the same loss, after allowing for the applicable excess and uninsured costs.

8. Optional Damage Waiver

8.1 The Damage Waiver is optional and only applies when it is selected and paid before the Hire Period begins.

8.2 The fee is 10% of the equipment hire subtotal, with a minimum fee of $25 plus GST. It is not refundable after collection or dispatch.

8.3 For covered sudden and accidental physical damage, the Client's liability is limited to the lower of the reasonable repair or replacement cost and $1,000 per separate incident.

8.4 The Damage Waiver is a contractual limitation of liability. It is not an insurance policy and does not make the Client an insured or beneficiary under Creative Kicks' insurance.

8.5 The Damage Waiver does not cover loss, theft, unexplained disappearance, late return, cleaning, consumables, ordinary wear and tear, intentional or reckless conduct, misuse, unauthorised use, sub hire, breach of security requirements, unauthorised repair or modification, dishonest information, damage caused by ignoring instructions, or damage involving water, salt water, sand, smoke, hazardous substances, unattended Equipment or courier transit unless Creative Kicks expressly confirms that risk as covered in writing.

8.6 A separate $1,000 cap applies to each separate incident. Related damage caused by the same event is one incident. Creative Kicks may require reasonable information and cooperation for an insurance claim.

9. Creative Kicks insurance

9.1 Creative Kicks currently maintains insurance that may respond while Equipment is dry hired, subject to the policy terms, exclusions, security requirements and a current $1,000 excess.

9.2 The Client has no right to require Creative Kicks to make a claim. Creative Kicks may decide whether a claim is appropriate, acting reasonably and consistently with the policy.

9.3 The Client remains responsible under this Schedule except to the extent the Damage Waiver applies or Creative Kicks receives an insurance recovery that must be credited under clause 7.4.

9.4 The Client should obtain its own insurance where the hire value or project risk warrants it and name Creative Kicks as an interested party.

10. Cancellation by the Client

For a change of mind cancellation, the following refund applies to amounts paid for the Hire Fee:

  • 48 hours or less before the Hire Period begins: no refund.
  • More than 48 hours but less than 15 days before the Hire Period begins: 50% refund.
  • 15 days or more before the Hire Period begins: full refund.

Approved non recoverable third party costs remain payable. These cancellation terms do not limit any remedy available where Creative Kicks breaches a non excludable obligation.

11. Couriers, freight and delivery

11.1 For a carrier arranged by the Client, risk passes when the Equipment is handed to that carrier and remains with the Client until Creative Kicks receives and checks it back in.

11.2 For a carrier selected and arranged by Creative Kicks, Creative Kicks is responsible for loss or damage during the carrier's custody to the extent Creative Kicks is legally responsible for that carrier. The Client remains responsible for inaccurate delivery details, absence at the agreed delivery, unsafe drop instructions or a Client requested unattended delivery.

11.3 The Client must provide tracking and proof of collection for a carrier it arranges and must not authorise an unattended drop without Creative Kicks' written approval.

12. Recovery and ownership

12.1 The Equipment remains the property of Creative Kicks at all times.

12.2 If the Client fails to return the Equipment, Creative Kicks may require immediate return, suspend other bookings, report suspected theft, and use lawful recovery processes. Creative Kicks will not enter private property or use self help recovery unless legally entitled and safe to do so.

12.3 The Client must promptly notify Creative Kicks if the Equipment is seized, subject to a lien, or claimed by another person.

Acceptance

By signing, approving the Quote online, confirming acceptance in writing, paying the required deposit, or instructing Creative Kicks to commence work after receiving these documents, the Client accepts this Schedule and the Creative Kicks Master Terms 2026.
