6. Sensitive information

Sensitive information has a particular meaning under Australian privacy law and includes information such as health information, racial or ethnic origin, religious beliefs, political opinions, sexual orientation and criminal record information.

Creative Kicks does not generally need sensitive information to provide its services.

If sensitive information is required for a particular legitimate purpose, we will only collect or use it where permitted by law and, where required, with consent.

Please avoid providing sensitive information to us unless it is genuinely required.

7. Who we may disclose information to

We use third party systems and service providers to operate the business.

Personal information may be disclosed to service providers where reasonably necessary for them to perform services on our behalf or help us complete a booking or project.

These may include:

  • Rental booking and equipment management providers such as Booqable
  • CRM and client management providers such as Dubsado
  • Payment providers such as Stripe
  • Accounting and financial systems such as Xero
  • Email, document and cloud productivity providers such as Google Workspace
  • Website hosting, content management, security and technical infrastructure providers
  • Analytics and advertising providers where enabled
  • Delivery, freight and courier providers
  • Contractors, technicians, production crew and subcontractors working on a project
  • Venues, clients or production partners where information is required for access, logistics or delivery
  • Insurers and insurance advisers
  • Accountants, lawyers and other professional advisers
  • Government agencies, regulators, courts, law enforcement or other parties where required or authorised by law.

We seek to limit disclosure to information reasonably necessary for the relevant purpose.

A service provider’s own handling of personal information may also be governed by its privacy policy and contractual obligations to us.

8. Overseas processing and disclosure

Some of the software and infrastructure providers we use operate outside Australia or use international data centres and subprocessors.

As a result, personal information may be stored, processed or accessed outside Australia.

Depending on the services involved, these locations may include the United States, the Netherlands, Ireland, Luxembourg, the United Kingdom, Spain, Israel and other locations used by our service providers.

For example, Booqable operates from the Netherlands and uses a number of international infrastructure and service providers. Dubsado operates from the United States. Other global providers may process information in multiple countries.

Provider infrastructure and processing locations can change over time.

Where Australian privacy law applies to an overseas disclosure, we take reasonable steps required by that law in relation to the handling of personal information.

9. Payments

Payments may be processed through third party payment providers.

Creative Kicks does not need to receive or store your complete payment card details where those details are entered directly into a payment provider’s secure payment system.

Payment providers may collect information necessary to process a payment, confirm a transaction, prevent fraud, issue a refund or manage a card authorisation or security hold.

Their handling of payment information is also subject to their own privacy and security practices.

10. Marketing communications

We may use contact information to communicate with existing or prospective customers about Creative Kicks services, equipment or relevant business updates where permitted by law.

Marketing communications will provide a way to unsubscribe where required.

You can also ask us at any time to stop using your personal information for direct marketing.

Transactional communications relating to an active enquiry, quote, booking, invoice, equipment return or project are not marketing communications and may still need to be sent.

11. Cookies and similar technologies

Our website uses cookies and similar technologies.

A cookie is a small piece of data stored by a website or service on your browser or device.

We may also use technologies such as browser storage, tags and tracking pixels. References to cookies in this policy include similar technologies where relevant.

Strictly necessary cookies

Some technologies are required for the website and booking system to operate.

They may be used for purposes including:

  • Website security
  • Fraud prevention
  • Maintaining website or booking sessions
  • Remembering privacy preferences
  • Managing hire dates
  • Maintaining a shopping cart
  • Completing bookings and checkout
  • Authenticating customer sessions.

Disabling these technologies may prevent parts of the website from functioning properly.

Functional cookies

Functional technologies may remember choices or provide additional website functionality.

These can include settings or preferences relating to the website, products, hire dates or booking process.

Analytics

We may use analytics technologies to understand how visitors find and use the Creative Kicks website.

Information may include:

  • Pages viewed
  • Referring websites
  • Approximate location
  • Browser and device type
  • Website interactions
  • Session information
  • Conversion activity.

We use this information to improve website performance, navigation, content and the effectiveness of our marketing.

Advertising and marketing technologies

Where enabled, advertising technologies may be used to measure advertising campaigns, understand whether advertising results in enquiries or bookings and make advertising more relevant.

This can involve advertising platforms receiving information about activity on our website.

We do not intentionally configure advertising or marketing technologies to collect the contents of private enquiry fields, payment details, identity verification documents or other information submitted through private customer forms.

Embedded and third party services

Parts of the website may use or link to services operated by third parties, including booking systems, video platforms, maps, social media or other embedded content.

Those services may use their own cookies or similar technologies when they are loaded or when you interact with them.

Their privacy practices are governed by their own policies.

12. Managing your cookie preferences

The Creative Kicks website provides controls for managing non essential cookies and tracking technologies.

You can:

  • Accept optional cookies
  • Reject non essential cookies
  • Manage individual cookie categories
  • Change your preferences later using the Cookie Settings link in the website footer.

Strictly necessary technologies cannot generally be disabled through these controls because they are required for core website or booking functionality.

You can also block or delete cookies using your browser settings. Blocking all cookies may affect website, cart, account or booking functionality.

13. Website tracking and private information

We take a privacy conscious approach to website tracking.

Tracking technologies should not be placed on identity document upload pages, payment fields or other areas in a way that intentionally sends the contents of private or sensitive customer information to advertising platforms.

Analytics and advertising configurations may change as the website evolves. We will update this policy where those changes materially affect how personal information is handled.

14. Security

We take reasonable steps appropriate to the information and systems involved to protect personal information against misuse, interference, loss and unauthorised access, modification or disclosure.

These steps may include access controls, authentication measures, restricted staff access, secure service providers, system security controls and appropriate procedures for handling higher risk information such as identity documents.

No online or electronic storage system can be guaranteed to be completely secure.

If we become aware of a data breach, we will assess and respond to it in accordance with applicable law, including notification obligations under the Notifiable Data Breaches scheme where that scheme applies.

15. How long we keep personal information

We do not apply a blanket retention period to every type of personal information.

How long information is retained depends on why it was collected and whether it is still reasonably required for business, contractual, accounting, insurance, dispute management or legal purposes.

Some financial and business records must be retained for periods required by law.

Higher risk information, including identity verification documents, should not be kept for longer than reasonably necessary for the purpose for which it was collected unless there is a lawful reason to retain it.

Where personal information is no longer required and applicable law permits, we take reasonable steps to destroy it or de-identify it.

Backup systems and third party platforms may retain information for additional periods according to their normal backup and deletion processes.

16. Accessing or correcting your information

You can ask us for access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

Contact us using the details below and tell us what information you are requesting.

We may need to verify your identity before providing access or making a correction.

We will not charge you simply for making a request. Where permitted by law, reasonable costs associated with providing access may apply and we will explain those costs beforehand.

There may be circumstances where we are permitted or required to refuse access or correction. Where required by law, we will explain the reason.

17. Privacy complaints

If you believe we have mishandled your personal information, contact us and provide enough detail for us to understand the issue.

We will review the complaint, investigate where necessary and respond within a reasonable period.

Where the Privacy Act applies and you are not satisfied with our response, you may also have the right to complain to the Office of the Australian Information Commissioner.

18. Third party websites

Our website contains links to websites and services operated by other organisations.

We are not responsible for the privacy practices of an independent third party once you leave our website or deal directly with that provider.

You should review the relevant provider’s privacy information where appropriate.

19. Changes to this policy

Our website, booking systems and service providers change over time.

We may update this Privacy & Cookies Policy to reflect changes to our business practices, technology or legal obligations.

The current version will be published on this page and will show the date it was last updated.

Where a change materially affects how we handle personal information, we may take additional reasonable steps to notify affected individuals where appropriate.
