EQUIPMENT TERMS AND CONDITIONS

Depending on the booking, the contract may include:

A document only overrides another document where the change is clear and specific.

Covers booking and payment, security bonds and card holds, the hire period, customer responsibility, equipment condition and faults, permitted use, returns and extensions, late returns, cleaning and packing, missing items, loss, theft and damage, the optional Damage Waiver, our insurance, change of mind cancellations, couriers, freight and delivery, and ownership and equipment recovery.

Applies across all Creative Kicks bookings and services. Covers contract documents and acceptance, quotes and scope, client instructions, fees and GST, deposits and payment, variations, expenses and third party costs, cancellations and postponements, suspension and cancellation by Creative Kicks, permissions and client materials, intellectual property, portfolio use, subcontractors, safety and access, storage and delivery, confidentiality and privacy, Australian Consumer Law, liability, indemnity, force majeure, complaints and disputes, and governing law.

Hire fees must be paid before collection or dispatch unless we've approved account terms. A security bond or card hold applies. The minimum is $200 and may increase with the booking value and risk.

48 hours or less: no refund. More than 48 hours but less than 15 days: 50% refund. 15 days or more: full refund. Approved non recoverable third party costs remain payable.

The customer is responsible for the equipment from handover until we receive and check it back in, except for fair wear and tear or loss or damage caused by us or a carrier we're responsible for.

Every item, case, cable and accessory must be returned on time, clean, dry, correctly packed and in the condition supplied, allowing for fair wear and tear. Late return, cleaning, repacking, missing item, repair and replacement charges may apply.

The Damage Waiver costs 10% of the equipment hire subtotal, minimum $25 plus GST. For covered sudden and accidental physical damage, liability is capped at the lower of the reasonable repair or replacement cost and $1,000 per separate incident. Not insurance, exclusions apply.

Only competent and authorised people may use the equipment. It must not be sub hired, altered, repaired, relocated or used for an unlawful, unsafe or unintended purpose without written approval.

Nothing in the Creative Kicks terms excludes, restricts or modifies a consumer guarantee, right or remedy that can't legally be excluded, restricted or modified. That's not us being generous, it's the law, and it stands regardless of anything else on this page.
